Legal basis
The pension fund of the Hamburg Chamber of Dentists was founded by chamber resolution and official approval on May 1, 1964, in order to grant all members of the chamber and their families a legal entitlement to pension benefits in old age, in the event of death and in the event of occupational disability.
The pension fund is an integral part of the Hamburg Chamber of Dentists and is run as a public corporation with partial legal capacity. It can act, sue and be sued in its own name.
Supervision is exercised by the Hamburg Authority for Health and Consumer Protection. The legal basis for the pension fund is the Hamburg Chamber Act for the Medical Professions (HmbKGH) and the pension fund statutes of the Hamburg Chamber of Dentists.
All members of the Hamburg Chamber of Dentists who work as dentists in the state of Hamburg or receive income in lieu of income from dental work are required to be insured.
Administrative bodies
According to § 2 of the pension statutes, the following are the administrative bodies responsible for carrying out the tasks of the pension fund:
- the Assembly of Delegates of the Dental Association
- the pension committee (managing committee according to § 7 paragraph 7 HmbKGH)
Supply Committee
- The pension committee conducts the business of the pension fund insofar as it is not assigned to other bodies by the pension fund statutes or the administrative guidelines; in doing so, it avails itself of the advice of the actuary, the in-house counsel and the full-time managing director. In addition, it implements the resolutions of the Assembly of Delegates and manages the assets of the pension fund.
- The pension committee decides on applications submitted in accordance with the pension statutes and, in particular, determines the pension benefits for members and their surviving dependents. The objections committee of the dental association decides on objections, provided that the pension committee, after hearing the board of the dental association, does not remedy the objection.
